Fortis Collective provides marketing, technology, and advisory services including but not limited to website design, SEO, branding, logo design, email marketing, print materials, custom merchandise, directory listings, digital marketing strategy, business consulting, ongoing marketing management, web, mobile, and desktop application development, website and email hosting, VoIP telephone services, and management of virtual and dedicated servers. Specific deliverables, timelines, and fees will be outlined in individual proposals or service agreements.

Business consulting and marketing management are advisory and execution services. Recommendations we provide are based on the information available to us and our professional judgment; we do not guarantee any specific business, revenue, or ranking outcome. Final business decisions remain yours.

1a. Hosting, VoIP, and Server Services

Hosting, VoIP, and server management are provided on an ongoing subscription basis and may depend on third-party providers, data centers, and carriers. While we work to maintain reliable service, we do not warrant uninterrupted or error-free availability, and we are not liable for outages, data loss, or service degradation caused by upstream providers, network carriers, or events outside our reasonable control. Any uptime commitments, backup retention periods, and support response times will be stated in your individual service agreement. You are responsible for the lawful use of any telephone, email, or server services we provide, including compliance with applicable telecommunications and anti-spam regulations.

2. Use of the Website

You agree to use this website only for lawful purposes. You may not:

• Attempt to gain unauthorized access to any part of the site

To the fullest extent permitted by law, Fortis Collective shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our total liability for any claim arising out of or relating to these Terms or our services shall not exceed the total amount paid by you to us for the specific services giving rise to the claim.

7. No Guarantees

While we strive for excellent results, marketing outcomes (including search rankings, traffic, leads, or sales) depend on many factors outside our control. We do not guarantee specific results.

8. Termination

Either party may terminate a service engagement according to the terms of the applicable proposal or agreement. Upon termination, you remain responsible for payment of all work completed up to the termination date.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles. Any disputes shall be resolved in the state or federal courts located in New Jersey.
